IRONCLAD GRAPHICS TERMS OF SERVICE 2020
All projects require a 100%% pre-payment before production begins.
JOB CHANGES AFTER APPROVAL
-If we have sent you an artwork/job approval form, and you have approved the specs, we will move the job into production.
-If you request changes, after having approved the proof or job specs, you will be charged $35.00 for the changes and any additional fees necessary to issue the change.
Job changes after approval can also delay your job depending the extent of the changes.
Jobs cannot be changed after approval and maintain the same delivery dates.
REFUNDS & RETURNS
-We do not offer refunds for custom printed products unless the product or printing can be proven to be defective.
-Any and all misprints or production issues need to be declared to the company no later than 5 business days after receipt of the printed goods. Requests for returns, refunds or discounts will not be considered after the 5 business day period is over.
-Customers cannot order products, then change their mind after production, and expect to return products for refunds or replacement.
-Failure to do due diligence on the part of the customer, be it approving mockups or looking at samples, is not grounds for refunds or replacements of any printed goods.
-Ironclad Graphics is not responsible for any costs, expenses or problems, issues, concerns or complaints related to the proper delivery of printed goods as per our contract agreements.
-Ironclad Graphics is not responsible for any perceived loss of time, extra costs the customer chooses to incur for their project, or compensation for manufactured emotional distress.
LIMITED PRODUCT WARRANTY
We warrant to the Buyer that our products are free from defects in material and workmanship; limiting our obligation under this warranty to replacement of the product if we are satisfied it was defective at the time of sale. This warranty does not extend to any persons obtaining the product from the Buyer.
THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND OF ANY OTHER OBLIGATIONS OR LIABILITY ON OUR PART. UNDER NO CIRCUMSTANCES WILL WE BE LIABLE FOR ANY LOSS, DAMAGE, EXPENSE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING IN CONNECTION WITH THE USE, OR INABILITY TO USE, OUR PRODUCTS. There are no warranties extending beyond those described and, where applicable, additional written warranties as to certain special products of ours. Our sole responsibility and the Buyer’s exclusive remedy for any claim arising out of the purchase of any product in this catalog is repair, replacement or credit, where applicable. In no event: (1) shall the cost of the remedy exceed the purchase price; (2) shall Ironclad Graphics Inc. be liable for any special, indirect, incidental, consequential, or exemplary damages, howsoever arising, even if we have been advised of the possibility of such damages.
QUOTING & INVOICING
All quotes for apparel will include all setup and printing costs. As well as taxes and any other fees. No additional fees will be added to invoices without prior discussion and approval between the customer and Ironclad Graphics.
SHIPPING & FOB
All packages that leave our shop are in the possession of the shipping company. Package that are delayed due to issues not related to Ironclad Graphics, are the responsibility of the courier or shipping company. Ironclad Graphics will incur no expense or liability for the improper or delayed delivery of printed goods.
ARTWORK CONTENT POLICY
-We reserve the right to not print artwork that depicts acts that are illegal and would be illegal, or assumed to be illegal by any reasonable person.
-We reserve the right to not print artwork or products that make our employees feel uncomfortable, unsafe or threatened. This includes discrimination, violence, racism etc
-We won’t print racist artwork. Racists suck. Go somewhere else.
-We won’t print for any illegal or banned organizations, such as criminal organizations, terrorist groups, or any group or organization that runs in contrast to our companies core vales, or threatens the dignity or safety of our employees.
Setup fees and charges include the cost of labour to setup and produce printed goods. Any tools, inks, films, strike offs and proofs are the property of Ironclad Graphics and are in no way covered in setup fees.
We provide a digital proof for all customers when they order. This is designed to show you what the finished product will look like. The proofs will show location and approximate size of the finished piece. If you want to know exactly what the size of the print is, you need to refer to the included job specs, and use a ruler to decide if the print is of sufficient size. We have standard print locations for “Full Front” “Left Chest” “Full Back” and “Shoulder Blade” prints. If your print requires special placements other than standard print locations, please let us know in detail where you would like the print.
Adjustments to mockups or digital proofs, without adjustments to the actual job order, will be billed at $30.00 a change. This is to cover the excess and pointless task of moving artwork 1/64″ in different directions, without actually changing placement or image sizes of the actual printed graphic. Always remember that the mockups show approximate location, and approximate size of the print. Different shirts are different sizes, yet the print remains the same.
Rush jobs will have a 20% fee added for any jobs due under our normal turn around time of two weeks. Jobs needed in 2-3 days will have 50% added to the cost.
CUSTOMER SUPPLIED MERCHANDISE
We generally don’t accept customer supplier garments, unless they are from customers with large volume and specific garment needs. The supplier of the garments will be responsible for all rejects up to 10%, and will replace as necessary and at their discretion. We offer this service on a case by case basis, so it is best to contact us first before purchasing any garments for printing.
All apparel printing inks can be mixed to match the Pantone Matching System (PMS) Solid Coated books.
Customers that supply Pantone colours must understand the following: Our colours are chosen out of approved and recent Pantone Books. We assume any Pantone colour submitted to us will also be chosen out of these books. Pantone colours chosen our of Photoshop or Illustrator will not necessarily be accurate to actual Pantone books, and thus we cannot assure proper colour matching during production.
Since we don’t make the garments, we can only offer so many assurances as too fit and consistency. Because apparel is still sewn by real people, sometimes in various locations, variations in size, colour and finish are possible. We do our absolute best to check the shirts for defects before printing, but due to the volume of production 100% perfection cannot be assured.
Customers approve final garment choice. If you are unhappy with your choice, we are unable to replace or offer refunds.
We are subject to our suppliers availability. If they are out of stock of a certain colour shirt, then we cannot assure delivery and will not be held liable for any losses, real or imagined, by lack of supplier stock.
All orders are considered complete if the final unit count is +/- 5%. This is a standard across the manufacturing sector.
You will not be billed for extras, and you won’t be charged for any misprints.
